TERMS AND CONDITIONS OF USE

1. Introduction

We are committed to providing you with a seamless, enjoyable, and trustworthy shopping experience. These Terms and Conditions (the “T&Cs”) apply to the website www.kidmoro.com (the “Site”) and govern the terms on which Kidmoro supplies products and services to you.

Please read these T&Cs carefully before using the Site. By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these T&Cs.

 

2. Information About Us

If we need to contact you regarding your order or for service-related matters, we will do so by telephone, email, or in writing to the address or contact information provided in your order. For these T&Cs, the terms “writing” or “written” include electronic correspondence such as email.

 

3. Accessing and Using the Site

As a condition of your access to and/or use of the Site, you represent and warrant that:

• All information provided by you on the Site is accurate, current, and complete;
• You are at least 18 years of age; and
• You will not copy, reproduce, distribute, or otherwise use any part of the Site or its content without Kidmoro’s prior written authorization.

You are solely responsible for your access to and/or use of the Site and all materials therein.

If you create a user account and password, you must treat such credentials as confidential and must not disclose them to any third party. Kidmoro reserves the right to disable any user account at any time if, in its opinion, you have failed to comply with any provision of these T&Cs.

 

4. Prohibited Activities

You agree not to:

1. Use the Site for any unlawful purpose or in violation of applicable laws, regulations, or internet standards;
2. Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
3. Attempt to gain unauthorized access to, interfere with, or disrupt any part of the Site or its connected networks;
4. Upload or transmit any material containing viruses, malicious code, or other harmful components; or
5. Post, promote, or transmit through the Site any material that:
• infringes intellectual property or proprietary rights;
• is defamatory, obscene, fraudulent, or otherwise illegal; or
• may be deemed offensive or objectionable in our sole discretion.

 

5. Links to Third-Party Sites

The Site may contain links to third-party websites or payment platforms not owned or controlled by Kidmoro. You acknowledge that Kidmoro is not responsible for the content, privacy policies, or practices of such third-party websites. By using the Site, you expressly release Kidmoro from any and all liability arising from your access to or use of such third-party services.

We recommend that you review the applicable terms and privacy policies of any third-party websites before using them or submitting personal information.

 

6. Intellectual Property Rights

Kidmoro is the owner or lawful licensee of all intellectual property rights in and to the Site, including its content, design, and materials.

No content from the Site may be copied, reproduced, modified, adapted, uploaded, transmitted, or distributed in any form without Kidmoro’s prior written consent. You are solely responsible for obtaining such permission before using any materials from the Site.

 

7. Warranties and Liability

The Site, its content, and services are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, except those required by law.

Kidmoro expressly disclaims all representations and warranties, including but not limited to:

• The accuracy, completeness, or reliability of the Site’s content;
• The uninterrupted, secure, or error-free operation of the Site; and
• The correction of any defects or errors.

Without limitation, Kidmoro shall not be liable for:
(a) The fitness or suitability of any product for a particular purpose;
(b) Damage or loss arising from improper use, alteration, or negligence;
(c) Third-party claims arising from use of the Site or its content; or
(d) Any failure to provide products or services due to unpaid or delayed payments.

Payments are processed by third-party payment service providers. Kidmoro does not retain, store, or process payment data and disclaims liability for any loss or breach associated with third-party payment systems.

To the extent permitted by law, Kidmoro’s total aggregate liability for any order shall not exceed the amount paid by the User for that specific order.

 

8. Indemnities

You agree to indemnify, defend, and hold harmless Kidmoro, its affiliates, officers, employees, and agents from all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your access to or use of the Site;
• Your breach of these T&Cs;
• Any third-party claim of infringement or violation of rights by your actions; or
• Any negligent or unlawful conduct by you or your representatives.

 

9. Termination

Kidmoro reserves the right, at its sole discretion, to determine whether you have violated these T&Cs. In the event of a breach, Kidmoro may take any action it deems appropriate, including but not limited to:

• Suspension or termination of your access to the Site;
• Issuance of a warning;
• Legal proceedings for damages; and/or
• Disclosure of relevant information to law enforcement authorities.

Kidmoro shall not be liable for any loss or damage arising from actions taken in response to a breach of these T&Cs.

 

10. Orders and Payments

You may place an order by completing the order form on the Site. Submission of an order constitutes an irrevocable and unconditional offer to purchase.

Kidmoro reserves the right to accept or reject any order at its sole discretion. A contract is formed when you receive a confirmation email from Kidmoro. Each confirmed and fully paid order constitutes a separate agreement governed by these T&Cs.

All prices listed are in Singapore Dollars and subject to applicable taxes. Kidmoro reserves the right to amend prices at any time. Payment must be made within two (2) hours of placing the order, failing which it may be automatically cancelled.

If a product is mispriced or unavailable, Kidmoro reserves the right to cancel the order and issue a full refund, even if payment has been made.

 

11. Product Descriptions and Defects

Kidmoro strives for accuracy in all product descriptions. However, product images are for illustrative purposes only, and minor variations (within 0.8 inches) shall not constitute defects.

If you believe you have received a defective item, please contact kidmoro@viharbour.com.sg with your order number and photographs of the defect.

Products acknowledged as defective will be eligible for reimbursement of return postage. Returned items must be unworn, unwashed, unaltered, and with original tags intact.

 

12. Returns

We accept returns for eligible items that are unworn, unwashed, unaltered, and have tags intact.

Excluded from returns are:

• Items purchased with promotional codes;
• Sale items;
• Intimates, swimwear, accessories, and bags.

To initiate a return:

1. Complete the return note;
2. Pack the item securely in its original packaging; and
3. Send it using a trackable delivery method within:
• 10 working days (local orders), or
• 20 working days (international orders).

You are responsible for return shipping costs. Refunds, where approved, will be issued in the form of store credit within 14 days of receipt.

 

13. Incorrect Items

If you receive an incorrect product, contact customercare@kidmoro.com with your order number and a photograph of the item. Postage will be reimbursed for approved cases.

 

14. Delivery

Delivery costs will be displayed on the Site at checkout. Orders are processed and dispatched within approximately two (2) working days.

Delivery times are estimates only and not of the essence. Kidmoro shall not be liable for any delay in delivery howsoever caused.

 

15. Bounced Parcels

In the event of an undeliverable or unclaimed parcel, Kidmoro will contact you via email. Additional delivery or storage fees may apply. Unclaimed parcels after one (1) year shall be deemed forfeited.

 

16. Ownership and Risk

Risk in the product passes to you upon delivery. Ownership transfers only upon full payment.

 

17. General Provisions

• Returns, Replacements and Refunds: These apply solely to items purchased through the Site.
• No Agency: Nothing in these T&Cs constitutes a partnership, joint venture, or employment relationship.
• Assignment: You may not assign your rights under these T&Cs without prior written consent.
• Waiver and Severability: Failure to enforce any right shall not constitute a waiver. If any provision is held invalid, the remaining provisions shall remain in force.
• Third-Party Rights: No third party has any right to enforce these T&Cs.
• Governing Law: These T&Cs are governed by the laws of Singapore, and any dispute shall be subject to the non-exclusive jurisdiction of the courts of Singapore.

 

18. Gift Cards

Gift Cards are valid for one (1) year, non-refundable, non-transferable, and must be redeemed in a single transaction.

 

19. Store Credit

Store credit is issued in the form of an electronic voucher valid for three (3) months from the date of issue. It is non-transferable, non-refundable, and cannot be used for Gift Card purchases.

 

20. Updates

Kidmoro reserves the right to modify or update the Site and these T&Cs at any time without prior notice. Continued use of the Site constitutes acceptance of the revised T&Cs.
